Contractors Registration

Learn about special registration and certifications required for Construction Contractors.

In addition to registering and licensing your business with the Division of Revenue and reporting hiring with the Department of Labor, Delaware State law requires businesses who perform "Construction Services" to also be registered with the Delaware Department of Labor's, Office of Contractor Registration BEFORE their work begins in the State. You can start a new application for a Contractor Certificate or renew an existing Contractor Certificate on One Stop.

Frequently Asked Questions

Renewals on existing Contractor Registration Certificates are ONLY available within 90-days from a certificate's expiration date.

Log in to your One Stop account, navigate to your Dashboard and click on the 'Certificates' section. Find the certificate you wish to renew, click the renewal button (only will be present within the 90-day expiration window), and follow the prompts to renew.

One of the advantages of using the One Stop is you will receive multiple reminders to renew prior to certificate expiration.

You can ONLY renew a Contractor Certificate when the Certificate is within 90-days prior to expiration. To be eligible for the option of a discounted 2-year registration, you must renew your Contractor Certificate before it expires (other requirements also apply). If a Certificate expires before you have renewed it, you will need to submit a new Contractor Registration application.

First, go to the Delaware One Stop and create a new account. Then submit a request by completing the Form available here. Follow all instructions on the form and send a copy of the completed form to our e-mail at Contract.Registry@delaware.gov . Please be aware that this process typically takes at minimum one week to complete, as we will need to take steps to ensure this request is authorized. If after one week, the Certificate hasn’t appeared in the Dashboard of the newly associated One Stop account, please feel free to reach out to us to check on the status of the request.

This same process can be used if you previously obtained a Certificate by using a paper application process (mail-in application), and now want to associate it and manage it from an existing or new One Stop account.

You can ONLY renew a Contractor Certificate when the Certificate is within 90-days prior to expiration. All fees are non-refundable.

For a one year registration:

  • $200.00 if you perform Private Construction
  • $300.00 if you perform Public Construction
  • $500.00 if you perform Public and Private Construction

For a two year registration:

This option is only available to contractors who meet the following criteria:

  1. Must have been continuously registered for the last two consecutive years
  2. Renewal application must be received timely prior to expiration date
  3. No prior violations of State or Federal Labor Laws
    • $300.00 if you perform Private Construction
    • $500.00 if you perform Public Construction

Please have the following items ready the for the registration process:

  • FEIN / ITIN or full social security number(s) for Limited Liability Corporations
  • NAICS Code(s)
  • Full business name, address, telephone facsimile and email address
  • Name Business Type (i.e. Corporation, Limited Liability Corporation, etc.)
  • Out of State Business must provide full contact information for custodian of records Delaware registered agent
  • Contact information for each person with financial interest in business
  • Delaware Business License and Number
  • Workers Compensation Policy coverage for Delaware
  • Policy number
  • Digital Copy
  • Delaware Unemployment Insurance SUI number
  • Safety Plan compliant with Occupational Safety and Health Administration (OSHA) or evidence you are creating a compliant plan
  • Listing of any Labor Law violations or Fraud that occurred in last two (2) years. Will need to provide the dates and outcome of each violations (ie. Settlement, Compliance, fines/penalties, and/or court decisions)
  • Valid Credit Card for Payment (online) or check for paper registration form

Delaware’s Contractor Registration Act 19 Del.C. Chapter 36 requires all businesses who do construction services and/or maintenance in Delaware must register with the Delaware Department of Labor.

Fees for registration are based upon the type or types of work you do under the Act.

"Public Works" are projects that are under the jurisdiction of Delaware’s Prevailing Wage Law 29 Del.C. §6960. These projects are financed by Delaware State and/or Federal agencies and include public buildings (municipal buildings, hospitals, schools) transport infrastructure (roads, railroads, bridges, pipelines, canals, ports, airports) public services (water supply and treatment, sewage treatment, electrical grids, dams) etc.

"Private Work" is all other construction services or maintenance work being performed in the State of Delaware that are owned, controlled, or commissioned by a private party. Private parties include individuals, homeowners, other business entities, nonprofit associations, privately funded schools, hospitals, publicly traded companies, etc.

Delaware Office of Worker's Compensation

Delaware law, with limited exceptions, requires all employers to secure workers' compensation insurance to cover all their full-time, part-time, seasonal or occasional employees prior to hiring and working in the State.

Delaware Office of Unemployment Insurance

State and Federal Law requires employers to provide unemployment insurance coverage for their workers if they meet certain criteria. To find out if your business needs to register with the Office of Unemployment Insurance call 302-761-6576 for New Castle County or 800-794-3232 for Kent/ Sussex Counties.

Delaware Office of Safety & Health (OSHA Consultation)

Delaware State law requires those who perform construction services to have a Safety Plan that is compliant with OSHA. If you do not have a plan, please contact 302-761-8200.

After the Delaware Office of Contractor Registration receives a fully completed application and the corresponding fee, and assuming that there are no outstanding issues or violations, the Office of Contractor Registration will issue a Certificate of Registration.

Email: If you filed online, the certificate will be emailed to the business email address.

By Mail: If you submitted your application by mail, the certificate will be mailed to the mailing address provided on the application.
